Terms of Service for Ghosty AI

PLEASE READ THESE TERMS OF SERVICE ("TERMS") CAREFULLY. BY DOWNLOADING, INSTALLING, OR USING THE GHOSTY AI APPLICATION ("APPLICATION"), YOU AGREE TO BE BOUND BY THESE TERMS.

1. License Grant

Subject to these Terms, ghosty-ai.com grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal or internal business purposes.

2. User Account and Responsibilities

You are responsible for maintaining the confidentiality of your access key and for all activities that occur under your account. You agree that all information you provide is accurate and that you will keep it updated.

3. Acceptable Use and Prohibitions

You agree not to use the Application for any purpose that is unlawful or prohibited by these Terms.

a. Prohibited Activities: Prohibited activities include, but are not limited to:

  • Attempting to reverse engineer, decompile, or disassemble the Application.
  • Infringing on the intellectual property rights of others.
  • Transmitting any material that is abusive, harassing, defamatory, or otherwise objectionable.
  • Using the Application during proctored exams, standardized tests, or any assessment where external assistance is forbidden.
  • Submitting AI-generated content as your own original work in an academic or professional setting without proper attribution or permission, which constitutes plagiarism or academic/professional dishonesty.
  • Using the automation or "human-like typing" features to misrepresent your identity, presence, activity, or abilities to an employer, institution, or any third party.
  • Using the "Stealth" or transcription features for unauthorized recording, surveillance, or monitoring of conversations or activities.

b. Enforcement:

VIOLATION OF THESE TERMS, PARTICULARLY REGARDING ACADEMIC OR PROFESSIONAL DISHONESTY, WILL RESULT IN IMMEDIATE TERMINATION OF YOUR ACCOUNT AND LICENSE WITHOUT REFUND. We reserve the right to investigate any suspected violation of this policy.

4. Intended Purpose and Specific Feature Disclaimers

a. Intended Purpose as an Assistant Tool:

Ghosty AI is designed, marketed, and provided strictly as a productivity and assistance tool. Its intended purpose is to help users analyze information, generate code examples, practice for interviews, and augment their legitimate work and study efforts. It is NOT intended, designed, or licensed for use as a cheating tool, a means for academic dishonesty, or any form of misrepresentation.

b. AI-Generated Content: The Application uses third-party generative AI models (Google Gemini). The output is generated by AI and may contain inaccuracies, errors, or biases. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING, VALIDATING, AND USING ANY CONTENT GENERATED BY THE APPLICATION. We are not liable for any damages arising from your use of or reliance on AI-generated content.

c. Automation and "Human-Like Typing": The Application includes features that automate keyboard and mouse input. You are solely responsible for how you use these features. Use of these features to deceive, cheat, or violate the terms of any third-party service is strictly prohibited and is done at your own risk.

d. "Stealth" Features: The Application is designed to operate discreetly. You agree to use these features responsibly and ethically, and not for any illicit or unauthorized monitoring purposes.

5. Subscription and Payment

Our Services are offered on a subscription basis. By purchasing a subscription, you agree to pay the specified fees. All payments are handled by third-party payment processors. Subscriptions will automatically renew unless canceled.

6. Third-Party Services

The Application relies on third-party services, including Google Gemini and Cloudinary. Your use of the Application is also subject to the terms and policies of these third parties. We are not responsible for the availability or performance of these third-party services.

7. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ghosty-ai.com, ITS AFFILIATES, ITS OWNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE APPLICATION. OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Termination

We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

10. Governing Law

These Terms shall be governed by the laws of USA/INDIA/GERMANY, without regard to its conflict of law provisions.
